This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and American Trails, a national nonprofit organization ("American Trails," "we," "us," or "our"), governing your access to and use of the member-only portions of americantrails.org, including any associated databases, learning center content, resource library, organization directory, webinars, and related services (collectively, the "Service"). By creating an account, logging in, or otherwise accessing the Service, you agree to be bound by this Agreement. If you do not agree, do not access or use the Service.
The Service is intended for professionals, organizations, and individuals affiliated with the trails, greenways, and outdoor recreation sector. You must provide accurate, current, and complete information when registering for an account and must promptly update such information to keep it accurate. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at trailhead@americantrails.org of any unauthorized use of your account.
Subject to your compliance with this Agreement, American Trails grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own professional or educational purposes, and, where applicable, on behalf of your member organization. This license does not include any right to (a) resell or make commercial use of the Service or its content; (b) copy, reproduce, distribute, publicly display, or create derivative works from any content except as expressly permitted; (c) reverse engineer, decompile, or attempt to extract the source code of any software underlying the Service; (d) use any automated means (bots, scrapers, crawlers) to access the Service without our prior written consent; or (e) circumvent any access controls or membership restrictions.
Access to certain learning center materials, webinars, continuing education units (CEUs), certificates, and directory listings is limited to members in good standing or as otherwise authorized by American Trails. Certificates and CEU records generated through the Service reflect a historical record of completion and may not be altered by the user. Misrepresentation of certificate or CEU completion status is grounds for immediate termination of access.
You agree not to: (a) upload or transmit unlawful, infringing, defamatory, or harmful content; (b) impersonate any person or entity or misrepresent your affiliation with any organization; (c) interfere with or disrupt the integrity or performance of the Service, including through excessive automated requests; (d) attempt to gain unauthorized access to the Service, other accounts, or related systems; or (e) use the organization directory or any member data for unsolicited commercial solicitation.
All content on the Service, including text, graphics, logos, resource library materials, course content, and software, is owned by American Trails or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted above, no right, title, or interest in the Service or its content is transferred to you.
The Service may include content submitted by members, partner organizations, or third parties, as well as links to third-party websites. American Trails does not endorse and is not responsible for third-party content or the practices of linked sites.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. NOTHING ON THE SERVICE CONSTITUTES LEGAL, ENGINEERING, OR SAFETY ADVICE, AND ANY RELIANCE ON SUCH INFORMATION IS AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN TRAILS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. AMERICAN TRAILS' TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless American Trails from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of this Agreement, or your violation of any rights of a third party.
American Trails may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of this Agreement. Upon termination, your license to use the Service immediately ends, though provisions of this Agreement that by their nature should survive (including Sections 5, 7, 8, and 9) will continue to apply.
American Trails may modify this Agreement or the Service at any time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.
This Agreement is governed by the laws of the State of California (American Trails primary location), without regard to its conflict of laws principles, and any disputes shall be resolved in the state or federal courts located in California.

If any of the information we hold on you is inaccurate or incomplete, you may ask us to correct or complete it at any time.
You may request the deletion of any email we hold on you at any time.
Be aware that requesting deletion, unlike unsubscribing from specific emails, is total and irreversible. This means that we will also lose record of you having ever been in our systems, including any previous instructions you have given us opting out of specific emails types. If you re-join our systems, by voluntarily providing your personal information, you will appear to us as a new data subject. This does not affect your other rights in any way.
To request deletion of your personal information, contact trailhead@americantrails.org using the email address we hold for you or otherwise proving your identity.

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

End users can opt out by replying STOP or request more information by replying HELP. Message frequency varies. Message and data rates may apply.
